In a majority judgment ‚ Chief Justice Mogoeng Mogoeng‚ supported by three justices‚ held that policy making was fundamentally a power assigned by the Constitution exclusively to the executive Former Communications Minister Faith Muthambi was entitled to dump a requirement for “decryption” on the subsidised set top boxes to be provided to 5-million poor households.
